The Senate has five days to decide on the Digital Asset Market Clarity Act, aiming for clear crypto oversight before summer recess.

The US Senate faces a crucial five-day period to consider the Digital Asset Market Clarity Act before heading into summer recess. This legislation aims to clarify the regulatory landscape for cryptocurrencies by delineating the responsibilities between the Securities and Exchange Commission and the Commodity Futures Trading Commission. For over a year, this bill has seen various iterations, reflecting the evolving nature of digital assets in the financial ecosystem.

#What is the current status of the Digital Asset Market Clarity Act?

The House successfully passed the CLARITY Act, known as H.R. 3633, on July 17, 2025, with bipartisan support reflected in a vote tally of 294 to 134. Subsequently, on May 14, 2026, the Senate Banking Committee moved the legislation forward with a 15-9 vote. An updated version of the bill, consisting of 616 pages, was introduced on July 22, 2026. This latest text includes provisions addressing ethics requirements and asset classification frameworks.

#What does the bill propose?

The Digital Asset Market Clarity Act seeks to establish a framework for classifying digital assets. Under this legislation, some assets might be categorized as commodities, which would fall under the CFTC’s regulatory scope. In contrast, others would remain classified as securities and therefore be overseen by the SEC. Major cryptocurrencies like Bitcoin and Ethereum are expected to be classified as commodities according to the current proposal.

Additionally, the bill also focuses on stablecoins and decentralized finance, promising enhanced protections for developers operating within the DeFi space.

#How is the market responding to the legislative uncertainty?

As of early August 2026, Bitcoin's price has stabilized within a narrow range of approximately $64,650 to $65,000. The estimated probability of the Act passing before the end of the year hovers between 30 to 38 percent. Such probabilities indicate a lack of decisive momentum in market performance, leading to cautious investor sentiment. With legislative clarity still on the horizon, many investors are holding back from making substantial moves in either direction.
