The US Senate is on the verge of a pivotal vote regarding significant cryptocurrency legislation. Known as the Digital Asset Market Clarity Act, with the formal title H.R. 3633, this bill is anticipated to be presented to the Senate during the week of August 3, with a preliminary procedural motion likely to occur as early as July 27-28.

What does this legislation aim to accomplish? The Clarity Act is designed to clarify the regulatory oversight between the Securities and Exchange Commission (SEC) and the Commodity Futures Trading Commission (CFTC) when it comes to digital assets. This is a critical development for the cryptocurrency space, as it seeks to eliminate the confusion surrounding regulatory jurisdiction that has often plagued this market.

This bill was developed from a collaborative effort that merged drafts from the Senate Banking and Agriculture Committees. It was approved by the Senate Banking Committee with a vote of 15-9 on May 14, 2026. Moreover, a newly integrated ethics provision targeting conflicts of interest for government personnel was added to the merged draft that surfaced around July 27. Notably, President Trump played an instrumental role in fostering discussions about the ethics language during his talks with senators on July 16, accelerating the legislative timetable.
